Terms and conditions

Purpose of the service

CheckinSecure offers owners and managers of tourist accommodations in Spain a tool to collect their guests' data and manage the communication of that data to SES Hospedajes. CheckinSecure is operated by the party identified in the Legal notice.

Free SES service

The SES Hospedajes communication service is free for life, with no trial period and no obligation to purchase additional services. CheckinSecure may offer additional, optional products or services in the future, governed by their own terms and, where applicable, their own pricing.

These Terms are not marketing consent

Accepting these Terms and the Privacy policy is required to create an account, but it does not equal or imply consenting to receive commercial communications. That consent is always a separate, optional step, never pre-checked, and can be withdrawn at any time without affecting your account or your free use of SES Hospedajes -- see the Privacy policy, sections B-E.

Processing of guest data on behalf of the owner/manager

When CheckinSecure processes legal guest data on behalf of the Owner/Agency, that relationship is governed by the Data Processing Agreement (DPA), which forms an integral part of these Terms. Real guest-data processing is not activated until the Owner/Agency has accepted the current DPA for their account.

Owner / manager responsibility

Under RD 933/2021, the party legally obligated to SES Hospedajes remains the individual or entity carrying out the hospitality activity -- CheckinSecure facilitates the process technologically, but does not replace the obligated party. The owner/manager is responsible for:

  • Being correctly registered with SES.Hospedajes when required.
  • Holding valid SES credentials and profile.
  • Correctly configuring the owner, entity, and establishment code.
  • Providing accurate stay data.
  • Ensuring that the guest information they provide matches the guest's documentation or identifying information.
  • Reviewing and fixing issues CheckinSecure flags as needing action.
  • Complying with the legal obligations that fall personally on the obligated party.

CheckinSecure's responsibility

CheckinSecure provides a technology tool and is responsible for its own service under these terms. In particular:

  • We do not control SES.Hospedajes and do not guarantee the availability or responses of that external public system.
  • We cannot guarantee that SES will accept a submission if the data or configuration provided by the user is incorrect.
  • We do answer for our own contractual, technical, and data-protection obligations -- these terms do not exclude our liability for our own service failures.
  • Nothing in these terms excludes or limits our liability for anything the law does not allow to be excluded or limited (our own willful misconduct or gross negligence, death or personal injury caused by negligence, and the mandatory obligations that fall on us as data processor). Outside those cases, and since the SES service is free, our economic liability is limited to the amounts actually paid by the Owner/Agency to CheckinSecure for paid services (if any) in the 12 months prior to the triggering event.

Availability

CheckinSecure aims to keep the service available, without being able to guarantee 100% uptime.

Changes

These terms may be updated; relevant changes will be communicated reasonably.

Applicable law

These Terms are governed by Spanish law. Any dispute shall be submitted to the courts corresponding to the domicile of the operator identified in the Legal notice, without prejudice to any mandatory consumer-protection forum that may apply to users who qualify as consumers.
